IX. CHOICE OF LAW AND VENUE
These Terms and Conditions are entered into in the State of Texas and shall be governed by and construed in accordance with the laws of the State of Texas, exclusive of its choice of law rules. Each party to these Terms and Conditions submits to the exclusive jurisdiction of the state and federal courts, and waives any jurisdictional, venue, or inconvenient forum objections to such courts. B. Where do we collect information from you and how do we use it? We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us. You provide certain Personally Identifiable Information to us when you:
(a) Register as a volunteer for our programs and activities and register your email address with us;
(b) Send us email messages, submit forms or transmit other information to us by telephone or letter;
(c) Distribute email messages regarding our programs and activities; or
(d) Submit your credit card or other payment information (through a third party credit card processor) when donating funds on our Site.
We may also collect information from you at other points on our Site that state that such information is being collected.

We may, from time to time, send you email regarding our programs and activities. Only HealthCode (or agents working on behalf of HealthCode and under confidentiality agreements) will send you these direct mailings and only if you have indicated that you do not object to these offers. If you do not want to receive such mailings, simply tell us when you give us your personal information.
E. What security precautions are in place to protect against the loss, misuse, or alteration of your information?
We implement a variety of security measures to maintain the safety of your personal information when you donate or register as a volunteer. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway provider’s database which is only accessible by those authorized Users who have special access rights to such systems and are required to keep such information confidential. After a transaction, your private information (e.g., credit card number, social security number) will not be stored on our servers.
Unfortunately, no data transmission over the internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the internet that are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed; and© any such information and data may be viewed or tampered with in transit by a third party.
When you use our Site we will store cookies on your computer in order to facilitate and customize your use of our Site.
